In Texas, as throughout the rest of the country, the legal drinking age is 21 years old. How Do People Obtain Fake IDs in Texas?
There are many ways people obtain fake IDs in Texas. Some people borrow IDs from friends or older siblings who bear a resemblance to them. Other people may go online to purchase a fake ID. Some people even try to alter or forge their birth date on their driver’s license, or they may use a fake birth document to obtain a state ID card or a driver’s license. All of these methods are illegal in Texas and will result in serious penalties for those caught with a fake ID.
Possession of a Fake Driver’s License
The Texas Transportation Code outlines different ways of using a driver’s license that are illegal. These include:
- Knowingly possessing or displaying a driver’s license or certificate that has been altered or that is fake
- Lending a driver’s license or certificate to someone else
- Representing or displaying someone else’s driver’s license or certificate as your own
- Possessing more than one valid driver’s license or certificate
- Providing a false address, name, or false document when applying for a new driver’s license or renewal
- Knowingly providing a false statement, omitting information, or committing fraud when applying for a new driver’s license or renewal
When someone commits any of the above acts, they can be charged with a Class A misdemeanor. If convicted, the offense is punishable by up to one year in jail and a maximum fine of $4,000.
Misrepresentation of Age
The Texas Alcoholic Beverage Code prohibits minors from falsely claiming that they are 21 years of age or older, and presenting any document supporting that claim, to a person serving or selling alcoholic beverages. This is the most common offense related to fake IDs in Texas. The charge is classified as a Class C misdemeanor. For those convicted, the penalty is a maximum fine of $500.
